Terms of Service, Attention-Ready Schools
Effective date: [EFFECTIVE DATE]
Last updated: [LAST UPDATED DATE]
These Terms of Service ("Terms") are an agreement between you and The Attention Institute Inc. ("we," "us," "our"). They govern your use of attentionreadyschools.com (the "Site") and the Attention-Ready Schools™ program, including annual school membership, the standalone first session, the school registry, the podcast, and our free tools and resources (together, the "Services").
If you accept these Terms for a school, district, or other organization, you confirm that you are authorized to bind it, and "you" includes that organization. If you don't agree, don't use the Services.
1. Related policies
These documents form part of these Terms:
- our Privacy Policy, which explains how we collect, use, and share personal information;
- our Refund and Cancellation Policy [link], which governs billing, renewal, cancellation, and refunds;
- our Participant Guidelines [link], which apply to live sessions, case discussions, office hours, and recordings.
If these Terms conflict with a signed written proposal or agreement with your school or district, the signed document controls for that school or district.
2. What the Services are
Attention-Ready Schools is a K–12 professional development program for educators from The Attention Institute Inc.
Professional development for educators. Not medical care or diagnosis. The Services do not provide medical, psychological, or clinical care. They do not diagnose students, and they do not replace individualized clinical or educational services, evaluations, or a school's legal obligations (for example under IDEA, Section 504, or state law). Nothing in the Services is medical, legal, or clinical advice for a particular student.
These are program goals, not guaranteed student outcomes. Educator feedback published on the Site describes educators' experience of a session. It does not measure changes in student behavior or learning outcomes. Our cost estimator gives an illustrative estimate based on the inputs you enter. It is not measured savings or a prediction of program results.
3. Annual school membership
- What it includes. As described on the Site at the time of enrollment: nine two-hour live virtual training sessions, grade-band labs (K–2, 3–5, 6–8, 9–12), monthly case discussions and office hours, a recorded session library and classroom tools, a baseline and end-of-program reassessment with a one-page report, and certificates of completion for 18 training contact hours. The current list is on /schools.
- Term. "Twelve months from enrollment."
- Price. Based on your school's teacher count, as published at enrollment (currently 1–50 teachers $4,995/year, 51–100 $7,995/year, 101 or more $9,995/year). You're responsible for giving an accurate teacher count. [Raghu to confirm what happens if the teacher count changes mid-term.]
- Payment and renewal. "Pay by card." "Receipt by email." "Renews yearly; cancel anytime from your billing page." Billing, renewal, and cancellation are governed by the Refund and Cancellation Policy.
- Scheduling. Dates, times, time zone, recording access, and participation details are confirmed in writing for your school. Schools joining after the series has begun can use recordings of earlier sessions and attend upcoming live sessions.
- Additional training. Topics or sessions outside the series are not included in the annual price unless we confirm the scope and any additional cost in writing.
- Who may participate. The program serves your school's teachers, administrators, counselors, ESE teams, and paraprofessionals. Membership is for your school's own staff and may not be resold or shared with other schools. [Raghu to confirm.]
- Evaluation. Nothing in the program is part of any teacher's performance evaluation by us.
4. Standalone first session
Session one, "What am I actually seeing?", is a two-hour live faculty session available on its own for $995, as a "One-time charge." It is optional and not a prerequisite for membership. Any credit of the session fee toward membership is described in the Refund and Cancellation Policy. [PENDING RAGHU: credit terms Q1–Q4]
5. Districts, networks, and partners
District and multi-school arrangements are quoted separately and governed by the written proposal or agreement. [NETWORK / PARTNER PRICING AND TERMS: placeholder. Raghu to decide whether dioceses, school associations, and other networks are treated as districts.] A network or partner that shares our materials with its members does so under [PARTNER TERMS / co-branding permission], and doesn't become our agent.
6. The Attention-Ready School™ designation and the registry
- Designation. The Attention Institute Inc. issues the Attention-Ready School™ designation to annual member schools whose whole faculty completes the program and the baseline and reassessment. Buying membership does not automatically confer it. It is an independent program designation, not government accreditation or a state school grade.
- Seal. A designated school may display the designation seal on its own website and materials while the designation is current, following our usage guidelines [SEAL USAGE GUIDELINES]. We may require removal if the designation lapses or is misused. [Raghu to confirm whether the designation expires or must be renewed.]
- Registry. The registry lists schools using publicly available, school-level information and shows each school's Attention-Ready status. A listing as "Not yet designated" is a statement of program status only. It is not a rating of a school's quality. We try to keep the registry accurate but don't guarantee it. Schools can request a correction at [CORRECTION CONTACT / raghu@attention-institute.com]. [Raghu to confirm the source of registry data and the correction process.]
7. Podcast
Podcast episodes are for general information. Guests' views are their own and don't necessarily reflect ours. Guests appear under the terms agreed with them before recording [GUEST RELEASE: Raghu to confirm], including our right to record, edit, and publish the conversation. Episodes are "edited before publication." Podcast updates you sign up for are governed by the Privacy Policy.
8. Free tools and resources
Our free tools ("What am I seeing?", the cost estimator, the readiness check) and resources (e.g. downloadable guides) are provided "as is" for educators' general use. You may use them and share them within your school. [Raghu to confirm: may networks redistribute co-branded guides, and on what terms?]
9. Accounts, billing links, and accurate information
Billing is managed through a secure link emailed to the work email used at enrollment. Keep that email account secure, give accurate enrollment information, and tell us promptly about any unauthorized use.
10. Acceptable use
You agree not to:
- share student names, photos, or other identifying student information in sessions, case discussions, office hours, or messages to us (see the Participant Guidelines);
- record, screenshot, or redistribute live sessions or the recorded library except as we allow;
- share access, login links, or materials with people outside your school's membership;
- misrepresent your school's designation status, or use the seal or our marks without permission;
- scrape, bulk-download, or copy the registry or Site content, or use it to build a competing database, except as the law allows [Raghu to confirm, given the Site currently allows AI and search crawlers];
- interfere with, probe, or disrupt the Site or its security, or use it unlawfully.
We may suspend or end access for a violation, as described in the Refund and Cancellation Policy.
11. Intellectual property
The Site, curriculum, session materials, tools, recordings, reports, guides, the Attention-Ready Schools™ and Attention-Ready School™ names, and the designation seal belong to The Attention Institute Inc. or its licensors. [Raghu to confirm ownership of curriculum content developed by Eva Luther, BCBA, M.Ed.] During your membership we give your school a limited, non-exclusive, non-transferable license to use the materials and recordings internally for staff professional learning. You keep ownership of the content you provide. You give us permission to use it to deliver the Services, and to use de-identified, aggregated feedback to improve and describe the program. We won't publish identifiable quotes without permission.
12. Recordings
Live sessions [and case discussions / office hours: Raghu to confirm which] may be recorded for the member recorded session library. By joining, you agree to be recorded. You can turn off your camera, and you can use chat instead of speaking where the platform allows. Recordings are kept for [RECORDING RETENTION] and are available to member schools only for their membership term. If identifying student information is shared, we handle it as described in the Participant Guidelines. Personal information in recordings is covered by the Privacy Policy.
13. Disclaimers
The Services are provided "as is" and "as available," to the fullest extent allowed by law. We make no warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any student, staff, or school outcome, the uninterrupted availability of the Site, or that the Services will meet a particular legal or regulatory requirement. Professional development for educators. Not medical care or diagnosis.
14. Limitation of liability
To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Services is limited to the amount you paid us for the Services in the [X] months before the claim [LIABILITY CAP: Raghu/counsel to confirm]. Some jurisdictions don't allow these limits, so they may not apply to you.
15. Indemnity
[Counsel to decide whether to include one, and its scope. Public schools and districts often cannot agree to indemnify vendors.]
16. Changes
We may update these Terms. We'll post the new version with a new "Last updated" date, and we'll notify member schools of material changes by email. Changes don't affect a membership term already paid, except as the law requires or you agree.
17. Governing law and disputes
These Terms are governed by the laws of [GOVERNING LAW STATE], without regard to conflict-of-law rules. Disputes will be resolved in [VENUE / DISPUTE PROCESS]. [Counsel to note: public schools and districts may require their own state's law. A signed agreement controls in that case (Section 1).]
18. General
These Terms, the related policies, and any signed proposal are the entire agreement on this subject. If a provision is unenforceable, the rest stays in effect. A failure to enforce is not a waiver. You may not assign these Terms without our consent. Neither party is liable for delays caused by events beyond its reasonable control.
